Procedures for Disciplinary Action

Minor offenses and ordinary cases of personal misconduct or breaches of discipline are handled by the subject teacher or the class adviser as the case may be. At the end of each month, the adviser furnishes the Student Formation Team with a summary of the offenses committed by the students in their advisory class.
For minor offenses, an anecdotal record is filed in the Office of the Student Formation. Upon investigation, the Student Formation Team shall employ the necessary measures as stipulated in the Handbook.
Offenses of a more serious nature are referred to the Student Formation Team for resolution.
In resolving serious disciplinary cases, such as those that warrant suspension cancellation of enrolment or exclusion, due process will be followed. In fulfilling the requirements of due process the following steps are to be taken:
1. Preliminary investigation. Upon receipt of a complaint, the Student Formation Team conducts a preliminary investigation to determine if reasonable grounds for the complaint exist.
2. Written Complaint. Should the Student Formation Team find reasonable grounds for believing that an offense has been committed, a complaint notice shall be sent to the parents or guardian of the respondent.
3. Answer. The respondent should submit within three days a written explanation to the Student Formation Team. If respondent makes an admission, the Student Formation team is convened to decide on the case. If respondent refuses or does not respond within three days from receipt of the complaint, the Student Formation Team proceeds with the deliberation of the case. Finally, when there is need a hearing is conducted.
4. Hearing. When the case warrants, as when there is a question of fact, a hearing is conducted. All students
concerned and their parents will be given a notice of hearing at least two days before the actual hearing.
5. Decision. The Student Formation team is both a fact finding and an adjudicating body. It is duty bound to furnish all parties concerned with a copy of the decision- resolution within a reasonable period of time.
6. Motion for Reconsideration or Appeal. Within five working days (inclusive of Saturdays) from the receipt of decision-resolution, the respondent may submit in writing a motion for reconsideration to the SF Team or an appeal to the Principal. The decision of the Principal on the appeal is final.
It is important to note that the proceedings and hearings in a discipline case need not be like those in courts of justice. The right against self-incrimination, the constitutional rights of a person under custodial investigation and the rule on double jeopardy are not applicable.
